Jean Carroll's lawyer on Tuesday rebutted a claim that she was mentored by the judge who oversaw the rape defamation trial of Donald Trump, and said there is "no basis' to toss the recent $83.3 million verdict against the former president in Carroll's favor. Roberta Kaplan joined the firm in October 1992 and Lewis Kaplan left Paul, Weiss in August 1994 upon his confirmation as judge. Roberta Kaplan also told the judge in a letter that she reserved the right to "seek sanctions" against Habba for making "false and vexatious claims." As in the second trial, Roberta Kaplan represented Carroll and Judge Kaplan presided over the case. "We believe, and will argue on appeal, that the Court was overtly hostile towards defense counsel and President Trump, and displayed preferential treatment towards Plaintiff's counsel," Habba wrote.

A lawyer for a writer who says Donald Trump sexually abused her in the 1990s and then defamed her while president in 2019 said Saturday that the infamous “Access Hollywood” tape and two women who accused Trump of abuse will not be put before a New York jury considering defamation damages. Trump attended the trial for two of its first three days, only skipping it on Thursday, when he attended the funeral of his mother-in-law in Florida. Both women testified at the trial that ended last May. Trump, 77, has denied her claims in the last week during campaign stops, on social media and at a news conference. NEW YORK (AP) — Former President Donald Trump can wait a week to testify at a New York defamation trial where he could face millions of dollars in damages after a jury concluded that he sexually abused a columnist in the 1990s, a federal judge said Sunday. The judge also noted that he has learned that Trump, even while seeking to postpone the trial, had scheduled an evening campaign appearance on Wednesday in Portsmouth, New Hampshire. He said Trump's lawyers notified the judge on Friday that Trump planned to attend the trial.
